Welcome to KayCover's ownership (BookCoversByKay). By accessing our site and purchasing our digital products, you agree to be bound by the following terms and conditions. Please read them carefully before making a purchase.

Attribution

All book covers and digital assets provided by KayCover's ownership remain the intellectual property of the studio. Authors and publishers must provide clear credit to KayCover's ownership (or BookCoversByKay) in the front matter of the book (typically on the copyright page) or in the description of digital listings. The recommended format is: 'Cover Design by KayCover's ownership'.

Licensing & Usage

Upon full payment, the client is granted an exclusive license to use the final cover design for their book in print and digital formats. Premade covers are sold only once. You may not resell, sub-license, or redistribute the design as a standalone product. Once an author sells 250,000 units across all versions, they must contact KayCover's ownership for an extended license. Failure to do so is a violation.

Use of AI

KayCover’s designs are created by a human designer. We do not use AI-generated artwork or materials to create our covers, even if provided by the client. We carefully review our resources to avoid AI-generated content, but because many stock sites do not clearly label AI assets, mistakes are still possible. If we discover that any AI-generated material was used, we will replace it as soon as we become aware of it. By purchasing a premade or custom cover, you agree that the final design may not, under any circumstances, be uploaded to train any AI platform or be altered using AI tools. Any such use is considered unauthorized and a breach of license, and may result in immediate termination of your usage rights without refund.

Modifications

KayCover's ownership provides basic text customization for premade covers (Title, Author Name, Tagline). Extensive structural changes to the artwork may incur additional fees. We reserve the right to display the completed work in our portfolio for promotional purposes.

Custom Projects & Deposits

For custom design projects, a 50% non-refundable deposit is required at the onset of the project to secure your spot in our schedule. This deposit covers the initial creative exploration and consultation time. Your slot is not reserved until this deposit is paid in full; failure to make this payment means your date may be released to another client.

Design Expectations & Subjectivity

While KayCover's ownership will make reasonable efforts to capture the client’s vision, design is fundamentally subjective. If a client is repeatedly dissatisfied or difficult to work with, KayCover's ownership is not responsible for unmet expectations and will not provide refunds. Furthermore, we do not permit another designer to modify or build on our original project files.

Refund Policy

Because our designs are digital, all sales are final and non-refundable. Please remember to reach out to KayCover's ownership for an extended license if your book sales exceed 250,000 copies. We look forward to celebrating your success with you.

Liability

Clients are responsible for testing and proofing all final print materials. KayCover's ownership shall not be held financially or legally liable for any costs, fees, or expenses incurred from the use of the design. Upon approval, the client assumes full responsibility for the accuracy of all text and imagery. The studio is not liable for any indirect, incidental, or consequential damages, including loss of profits or data. Any claims regarding defects must be submitted in writing within 14 days of final approval.

Photo Usage and Rights

All images used in KayCover's ownership's designs remain the intellectual property of KayCover's ownership's. Similar or identical images, models, or concepts may be used by other designers or authors, and KayCover's ownership's is not liable for any resemblance to other works. The image may not be sold, reused, or repurposed outside of its intended book-related applications. Permitted use includes paperback and eBook formats, as well as associated promotional and online marketing materials. Use of the design or image on resale items beyond the book itself (print or digital) is strictly prohibited unless an extended license is purchased.

License Terms

The standard license does not include merchandise usage such as mugs, stickers, magnets, apparel, or similar products. An extended license is required if: The book exceeds 250,000 print copies, or The Client intends to use the design or imagery for merchandise or resale products.

File Delivery

The Client is responsible for downloading and securely storing all delivered files. Once files are delivered, they become the sole responsibility of the Client. Requests for redelivery may incur additional fees per file, except in extenuating circumstances determined at KayCover's discretion.

Confidentiality

All personal, business, and project-related information shared between the Client and KayCover's shall remain confidential and shall not be disclosed to any third party without prior consent.

Code of Fair Practice

KayCover's affirms that all work produced is, to the best of its knowledge, original or properly licensed. The Client agrees not to use any designs in a way that infringes upon the rights of third parties or includes unlawful, defamatory, or inappropriate content.

Defamation Clause

By purchasing any service, the Client agrees not to publish or distribute defamatory, harmful, or misleading statements about KayCover's on social media or third-party platforms. All concerns must be addressed directly with KayCover's to allow for resolution. Violation of this clause may result in legal action under applicable defamation laws, including the Defamation Act 2013.

Changes to Terms

KayCover's reserves the right to update or modify these Terms and Conditions at any time. Updates will be posted publicly.
Continued use of services after changes are posted constitutes acceptance of the revised Terms.

Acceptance of Terms

By purchasing or using KayCover's services, the Client acknowledges full acceptance of these Terms and Conditions. The Client agrees to hold KayCover's harmless from any and all liability, including financial liability. These Terms are non-negotiable.

Client-Provided Images

If the Client provides an image, the Client retains rights only to that image. The Client is solely responsible for ensuring proper licensing and permissions for any materials they provide and agrees to indemnify and hold harmless KayCover's against any claims, damages, or legal actions resulting from such materials.

Workflow and Scheduling

Clients are strongly encouraged to book services in advance. Additional revisions may extend timelines. KayCover's is not responsible for delays caused by: late bookings, delayed communication, or client-requested changes.
